Indian judiciary has been progressive about LGBTQ rights lately and that's great - I'm really really happy to see the judiciary being positive towards LGBTQ people. In 2018, the Indian supreme court decriminalized homosexuality. The court also offers legal recognition to cohabiting same-sex couples in the form of live-in relationships.

But I can't help but emphasize on the fact that the current ruling party of India, BJP, is very conservative and anti-LGBTQ in nature. A BJP leader tried to block a pride parade earlier this month in the Indian city of Pune - but they failed. 

Your regular Indian society is heavily patriarchic &amp; conservative in nature. A lot of the educated people in metropolitan Indian cities are transphobes &amp; homophobes. This ruling is a step in the right direction but we still have a long way to go.

As an Indian, the region as a whole has transgender communities and they have some protection in Pakistan and Bangladesh as well, despite being majority Muslim countries.

When most people talk about transgender people in the region, they most often talk about these groups, though the recognition of people being transgender outside those traditional communities is increasing. 

The courts are willing to affirm the right of transgender people as a "third gender", and issue decrees to protect their rights.

At the moment, cases have affirmed their rights to be recognized as women, men or transgender people, their right to heterosexual marriage (in line with the current laws only allowing heterosexual marriage), etc. 

One of the major hurdles is same sex marriage, the courts don't want to create something "new", so it's up to the legislative. LGBT rights isn't a political issue, which is good. However, it's not on the agenda of politicians as a result.

So first, they fought to be separate identity as a Trans person. Now, they fought to be recognized as Women.

The women in question transitioned from some other gender to Female surgically and is a Female now. Hence she should have rights of a female eg 498A. But her inlaws refuted that since she wasn’t born as such, she should not be eligible for protection under the law. Court ruled in her favour.

And the second one I saw was of men (again. shocking) worrying about "men dressed as women in women bathrooms" and "men getting benefits of women-centric schemes". First, I personally have never encountered the bathroom wala issue. Aur rahi baat schemes ki, aren't men the ones crying about women receiving benefits from these schemes? S just putting on a skirt sufficient to prove “transitioning”? Or Is medical transitioning ie gender reassignment surgery necessary for a transitioning person to be considered a woman?

Very progressive step. Hope making marital rape illegal is the next step. India needs to shake off medieval mindset, and law paves a way. Homosexuality became a little more acceptable with the law. Trans people’s rights need acknowledging, and this is what the law does. If left to society, they will keep dragging us back into grave of some Mughal ruler.

Growing up as a gay man under the thumb of Indian oppression, this is profound to me. Queerness has been been either invisible or hyper-visible in all the wrong ways in my experience . As a young gay person finding their way I felt pushed to the margins. This ruling is a declaration that trans women belong—not as a third option, not as an afterthought, but as women. I feel a well of emotions as the tides turn. I never thought I would live to  see the day where my culture would unlearn the bias that patriarchy has baked into all of us.

This ruling gives hope that change is happening! Slowly, imperfectly, but it is happening. And for queer Indians everywhere, it’s a reminder that we’re not anomalies. We’re not secrets. We’re not mistakes. We are people with lives and rights and futures. This is mega. ✌🏾
